Terms of Use — Fenua'p
Dernière mise à jour : juillet 2026. Fenua'p is a technical intermediation platform connecting clients with independent providers (transport, food & delivery, stays, activities) in French Polynesia. Fenua'p is not the carrier, restaurateur, host or tour operator: each service contract is formed directly between the client and the provider, who alone is responsible for its performance.
Accounts are personal; users may delete their account at any time in-app. A request (ride, order, booking) is an offer the provider is free to accept or decline; the service contract is formed upon acceptance. Prices are displayed in Pacific francs; taxi fares never exceed the maximum tariffs set by French Polynesian regulations (Order no. 1540 CM of 6 September 2023 for Tahiti and Moorea). Payment is made through the methods offered in the app at the time of the request: direct payment to the provider or, as they become available, electronic payment (bank card, e-wallet or any other offered method). Service fees, if introduced, will be clearly displayed beforehand and never applied retroactively.
Cancellation terms are shown before confirmation; if a provider cancels (including weather/force majeure), the client is informed in-app with the reason and any electronically paid amount is refunded. Fraud, abusive behaviour and platform circumvention may lead to account suspension. Reviews may only follow a genuinely completed service. Fenua'p uses reasonable means to keep the app available and secure and is not liable for the performance of services, which rests solely with providers, nor for indirect damages; nothing limits liability that cannot be limited by law.
Personal data processing is described in the Privacy Policy, an integral part of these terms. Material changes to these terms are notified in-app and subject to acceptance. These terms are governed by the law applicable in French Polynesia; disputes are subject to the competent courts of Papeete after an attempt at amicable resolution.
